These Terms & Conditions govern your use of the Colourfully Black website, the purchase of our products, and any services we provide. Please read them carefully, as they form a legally binding agreement between you and us.

If you do not agree to these terms, you should not use our website or purchase goods or services from us.

References in these terms to “we”, “us” or “our” mean ColourfullyBlack.com Ltd. References to “you” or “your” mean the customer or consumer.

3. How We May Contact You

We may contact you by telephone, email, SMS (with your consent), post, or social media. You can opt out of marketing communications at any time. We will only contact you in accordance with UK law and our Privacy Policy.

4. The Contract Between You and Us

When you place an order:

You select your products and provide your details.
You confirm your order and make payment.
We will send you an order confirmation email.
The contract is formed only when we send you an email accepting your order.

If there is an error in the ordering or payment process, we will correct it as soon as possible.

5. Prices & Payment

All prices are in pound sterling (£) and include VAT where applicable.
We accept Apple Pay, Visa Debit, Visa Electron, Mastercard, Maestro, and PayPal.
Payment is taken when you place your order. Orders are not dispatched until payment has cleared.

Pricing Errors

If we discover a pricing error after you place an order, we will notify you. You may then:

Continue with the order at the correct price;
Choose a different product; or
Cancel the order for a full refund.

We reserve the right to cancel any order with incorrect pricing, even after confirmation, in line with UK law.

6. Dispatch & Delivery

Dispatch date is the date we ship the goods, not the delivery date.
Delivery times are estimates and not guaranteed (except where a Special Delivery option is purchased).
Delivery charges will be shown before you confirm your order.
You are responsible for providing correct delivery details.
Risk passes to you on delivery or attempted delivery.

We are not responsible for delays outside our control (e.g., postal strikes, severe weather).

7. Cancelling Your Order

Under the Consumer Contracts Regulations 2013, you have the right to:

Cancel your order any time before dispatch for a full refund.
Cancel within 14 days of receiving goods (the “cooling-off” period).

Exceptions: No cancellation rights for personalised items, perishable goods, or digital products where download/streaming has begun with your consent.

How to cancel: Contact us in writing (email or post) within the 14-day period.

Goods must be returned within 14 days of cancellation, at your cost (unless faulty).
Refunds (including standard delivery) will be made within 14 days of us receiving the goods back or receiving proof of return.

8. Your Legal Rights (Summary – Consumer Rights Act 2015)

You are entitled to:

30 days: Full refund if goods are faulty.
6 months: Repair or replacement (or refund if unsuccessful).
Up to 6 years: A partial refund if goods do not last a reasonable time.

These rights apply in addition to any warranty.

9. Digital Products

We grant a non-exclusive, non-transferable licence for personal use.
No resale, modification, or distribution without written consent.
No refunds for digital products once download or streaming has begun, unless faulty.
We are not liable for technical issues beyond our control.

10. Intellectual Property

All content, branding, trademarks, and designs are the property of ColourfullyBlack.com Ltd. You may not copy, reproduce, or distribute them without permission.

11. Promotions & Offers

Each promotion will state eligibility criteria, dates, and conditions.
Promotions cannot be combined unless stated.
We may modify or withdraw promotions without notice if necessary.

12. Customer Reviews & Content

By submitting reviews or feedback, you grant us a licence to use them in any format for marketing or other purposes. We may edit or remove content that is inappropriate or unlawful.

13. Limitation of Liability

We are not liable for:

Indirect or consequential losses;
Losses caused by events beyond our control;
Losses due to your misuse of products.

Nothing in these terms excludes our liability for death or personal injury caused by negligence, defective products, fraud, or your statutory rights under UK law.

14. Events Beyond Our Control

If events outside our reasonable control delay or prevent us fulfilling our obligations, we are not liable for delays.

15. Privacy

Your personal data will be processed in line with our Privacy Policy and UK GDPR.

16. Governing Law

These terms are governed by English law, and any disputes will be heard in the courts of England and Wales.

17. Severability

If any part of these terms is invalid or unenforceable, the rest remains in force.
